1. Who we are and what these Terms cover
1.1 ClutterWorth (the "Service") is operated by [COMPANY_LEGAL_NAME], [REGISTERED_ADDRESS] (reg. no. [REG_NUMBER], VAT [VAT_NUMBER]) (the "Company").
1.2 These Terms govern use of the Service: the website, photo upload and scan flow, reports, and the optional rescan subscription.
2. The Service — estimated ranges, not appraisals
2.1 ClutterWorth provides estimated resale ranges and declutter suggestions for informational purposes only. It is not an appraisal service and does not promise sale outcomes. Actual sale prices vary by condition, local demand and timing.
2.2 All figures in reports are estimated ranges, not appraisals, and are based on typical listings for similar item categories and conditions.
2.3 Listing texts generated by the Service describe only what was visible in your photos; you must review them before posting anywhere.
2.4 No auto-posting, no buying: ClutterWorth does not post to marketplaces on your behalf, and does not buy items from users.
3. Photos, people and privacy
3.1 You confirm that the space you photograph is your own before upload.
3.2 Person-reject gate: photos with clearly visible people are rejected before any processing. No face data is stored or analyzed — no facial recognition, embeddings or landmarks are ever computed, logged or stored. See the Privacy Policy for details.
4. Purchases — Stripe as merchant of record
4.1 The Service offers one-time scans and an optional monthly rescan subscription, processed via Stripe acting as merchant of record under Stripe's managed-payments program (test mode until launch, G5). Your purchase contract for the paid product is concluded with Stripe, which resells the Service to you; Stripe (not the Company) charges you, issues your invoice or receipt, determines and remits applicable VAT/sales tax, and processes refunds and chargebacks under its own consumer-facing terms presented at checkout.
4.2 The Company remains your counterparty for the provision of the Service itself (access, functionality, support, data protection) under these Terms.
4.3 Where Stripe's checkout terms and these Terms conflict on payment, billing, tax or refunds, Stripe's terms prevail for those topics; for everything else these Terms prevail.
4.4 The Company never receives or stores your card data.
4.5 Subscriptions renew automatically each billing period until cancelled; cancel any time via the billing portal, effective at the end of the current period.
5. Refunds and EU 14-day right of withdrawal
5.1 Refund window: a 14-day refund window applies to purchases, handled via Stripe as merchant of record.
5.2 EU/EEA consumers have a statutory 14-day right of withdrawal from distance contracts (Directive 2011/83/EU as implemented).
5.3 Digital-content exception: for digital content and digital services delivered immediately (such as a scan report generated right after purchase), you may be asked at checkout to expressly consent to immediate performance and to acknowledge that you thereby lose the right of withdrawal once performance has begun or the content has been delivered, as permitted by Art. 16(m) of Directive 2011/83/EU. For subscriptions, withdrawal within 14 days of the initial purchase is honored per the applicable statutory rules and Stripe's consumer terms.
5.4 Nothing in these Terms limits mandatory statutory rights, including statutory warranty rights for digital content and digital services (Directive (EU) 2019/770 as implemented).
6. Acceptable use
6.1 Do not upload photos of spaces you do not control, photos of other people, or unlawful content; do not attempt to disrupt or reverse engineer the Service.
7. Liability
7.1 To the extent permitted by law, the Company is not liable for decisions you make based on estimated ranges, including sale prices achieved or not achieved. Mandatory consumer protections remain unaffected.
8. General
8.1 Governing law and venue: [GOVERNING_LAW / VENUE]; for consumers, this choice does not deprive you of the protections of your home country's mandatory law.
